Against criminal acts committed by TNI Members, the provision refers to Law Number 31 Year 1997 on Military Justice ("Law 31/1997").
Military justice is the executor of judicial power within the Armed Forces to enforce the law and justice with due regard to the interests of the organization of state security defense.
Courts within the jurisdiction of the military, one of which, is authorized to adjudicate criminal acts committed by a person who at the time of committing a crime is:
a. Soldiers;
b. which is based on the law equated with the Soldier;
c. members of a group or agency or body or equivalent or considered as a Soldier under the law;
d. a person who does not belong to the classes in letters a, b and c, but on the decision of the Commander of the Armed Forces of the Republic of Indonesia ("Panglima") with the consent of the Minister of Justice (now Minister of Law and Human Rights) shall be tried by a court within the military court .
The Armed Forces of the Republic of Indonesia (Pvt.) Are citizens who meet the conditions stipulated in the provisions of legislation and are appointed by the competent authorities to dedicate themselves in the defense of the state by carrying weapons, willing to sacrifice body spirit, and participate in national development and subject to military law.
Authorities Conducting Investigations in Military Justice
The Investigation is a series of actions by the Armed Forces Investigator of the Republic of Indonesia in respect of and in the manner set forth in Law 31/1997 to search for and collect evidence which with such evidence makes light of the criminal offense and to find the suspect.
Oditurat is the executive body of state power in the field of prosecution and investigation in the Armed Forces environment based on the devolved of the Commander, taking into account the importance of organizing the defense of state security.
While the Investigator is:
a. Eligible Boss Punish
Eligible Boss Punish is a direct superior who has the authority to impose disciplinary punishment in accordance with applicable laws and regulations and has the authority to conduct an investigation under Law 31/1997.
b. Military police
c. Oditur
An Otoritor shall be an officer authorized to act as a public prosecutor, as the executive of a judgment or determination of the Court within the jurisdiction of the military or the Court within the general court of justice in a criminal case, and as an investigator in accordance with the provisions of Law 31/1997.
Thus, Oditurat is the executive body of state power in the field of prosecution and investigation within the Armed Forces. While the conduct of the investigation is the Supreme Court Judge, Military Police, and Oditur.
